Photography Release Forms Explained: Model and Property Releases

What Is a Photography Release Form?

A photography release form is a legal document that grants permission to use photographs for specified purposes. In photography, there are two primary types: model releases (for photos of people) and property releases (for photos of privately owned locations, art, or intellectual property). These forms are critical for commercial use of photography and are routinely used by photographers, brands, advertising agencies, and stock photo libraries.

Model Release Forms

A model release is signed by a person who appears in a photograph, granting the photographer and/or client the right to use that image for specified commercial or promotional purposes. Without a signed model release, using an identifiable person's likeness in advertising, product packaging, or commercial marketing can expose you to significant legal liability under right-of-publicity laws.

Key elements of a model release include: the name of the person releasing rights, what images are covered, what uses are permitted (advertising, editorial, social media, etc.), duration of the license, and any compensation provided. For minors, a parent or legal guardian must sign on their behalf.

When You Need a Model Release

Model releases are required for:

Property Release Forms

A property release is signed by the owner of a privately owned location, building, artwork, or intellectual property that appears in a photograph. If you photograph a privately owned home's interior and use that photo in a commercial campaign, the property owner's consent may be required. Certain distinctive architectural elements and branded environments (think famous building facades or interior designs) may also require releases for commercial use.

Who Is Responsible for Obtaining Releases?

For commercial photography projects, responsibility is typically shared. The photographer is often responsible for obtaining model releases during the shoot, particularly if they're hired on a work-for-hire basis. However, the client (business or brand) commissioning the work ultimately bears the legal risk of using photos without proper releases.
